01Our commitment to your privacy
Your personal information matters to us. This Privacy Policy explains what personal information The Mortgage Advisers holds about you, why we hold it and what we do with it.
We follow the Information Privacy Principles in the Privacy Act 2020 (and any law that replaces it) and all other laws that apply to us. This policy sits alongside those laws and does not limit your rights or our obligations under them.
02Who we are
In this policy, “we”, “us” and “our” means The Mortgage Advisers, the financial advice business through which Sarah Hood (mortgage adviser) and Nik Trainin (financial adviser) provide advice and arrange home loans, insurance and related services for you.
We are a member of the Loan Market and Insurance Market group, operated by NZ Financial Services Group Limited (NZFSG). Section 09 explains how that membership affects your information.
03Your agreement
By giving us your personal information, asking us to provide services, or using this website, you agree to us collecting, using, storing and sharing your personal information as described in this policy.
04What personal information we collect
Personal information is information that identifies you, or could be used to identify you. It includes things like your name, date of birth, address, contact details, account details and occupation.
When you ask us for advice, we may also collect information about your financial position and goals so we can recommend the home loan and insurance products we are permitted to advise on (“Products”). For insurance, this can include health information.
05Why we collect it
We collect personal information so we, and the third parties described in section 09, can provide our services and manage our relationship with you. For example, to:
- Respond to your enquiries and requests
- Provide our services, including recommending Products that suit your situation
- Send you updates and marketing about products and services we think may interest you, by mail, phone, email or text
- Carry out market research
- Do anything else you authorise, or that the Privacy Act allows
You can opt out of marketing at any time by letting us know.
We may also collect personal information, including credit and health information, on behalf of the lenders, insurers and other providers you choose to apply to (“Product Providers”). Each Product Provider has its own privacy policy that applies to the information we collect for it.
06How we collect it
Most of the time we collect information directly from you, including through our website forms, phone calls, emails and meetings.
We may also collect information about you from:
- NZFSG (trading as Loan Market and Insurance Market) and its related companies
- Credit reporting agencies
- Your bank and employer, with your authority (for example, through a bank statement retrieval service such as illion)
- Product Providers, including during the term of a loan or policy we have arranged, so we can answer your questions and help as your circumstances change. Product Providers may also share your loan balance or premium with us in connection with ongoing commission
- Anyone else you authorise, or as the Privacy Act allows
If we collect information about you from someone else, we will take reasonable steps to let you know as soon as practicable, unless the Privacy Act says we do not need to.
If you give us personal information about another person, such as a partner or co-borrower, you confirm that they have agreed to us collecting, using and sharing it under this policy, and that they know they can access and ask to correct it.
07Keeping your information up to date
We rely on you to make sure the information we hold is accurate. If any of your details change, please let us know as soon as you can.
08Who we share it with
We may share your personal information with the following people where we consider it necessary for the purposes in section 05:
- NZFSG and its related companies. As a member of the Loan Market and Insurance Market group, we share information with NZFSG, including your identity, contact details and financial information. This allows us to provide our services and allows NZFSG to meet its monitoring, oversight and assurance obligations under the Financial Markets Conduct Act 2013 and the Privacy Act. Sharing with NZFSG is a condition of our service, so if you do not agree to it we cannot act for you. NZFSG’s own privacy policy, including how to access and correct information it holds, is at nzfsg.co.nz/privacy-policy
- Product Providers and other prospective lenders, insurers or intermediaries involved in your finance or insurance, including a lender’s mortgage insurer, guarantors, trustees, and anyone a lender or insurer proposes to contract with or transfer its rights to
- Referral partners who can help you with other services
- Our contractors and service providers
- Investors in our business, or anyone we may transfer or sell all or part of our business to
- Auditors, including NZFSG, who check that our advice is in your best interests and meets current regulations
- Your employer and referees, credit reporting agencies and identity verification services
- Regulators, government agencies and anyone else we are legally required or permitted to share it with
- Anyone else you authorise, or as the Privacy Act allows
Credit reporting agencies may keep your credit information, including any default information, on their systems and use it to provide credit reporting services to their customers.
Before we share your information with anyone, we take reasonable steps to make sure they are committed to protecting it at least as carefully as we do.
09Information stored or shared overseas
We may use cloud storage, and the servers holding your information may be located outside New Zealand.
We may also share information with NZFSG’s related companies and with suppliers and service providers based overseas for the purposes described in this policy.
